MortgageIT Overtime Violations

On August 10, 2007, we filed a collective action against MortgageIT seeking unpaid overtime on behalf of all loan officers who routinely worked 50 hours per week or more but were required by management to record only 40 hours per week on their time records. The complaint alleges that MortgageIT violated the Fair Labor Standards Act (“FLSA”) by maintaining inaccurate time records and failing to pay loan officers overtime at one and one-half times their regular rate of pay.
